Employment Contract Details
Contracts must be in Spanish and can be bilingual. The agreement should include information such as category, salary, working hours, trial period, termination date or undefined, confidentiality, obligation to keep personal information updated.
Maximum probation period is 90 days and is not mandatory.
Minimum Wage Requirements
The minimum salary may vary according to the activity. However, the minimum wage at the national level is UYU 17,930. For software activities the minimum wage is UYU 36,180.
Maximum working hours and overtime
Standard business hours are 8 hours a day with a work week Monday through Friday, 40 hours a week.
Overtime is paid at a double rate
Maternity leave: employees have the right to take a 100-day maternity leave. During this time, the salary will be covered by the BPS National Health Insurance in its entirety. Leave should start 42 days before birth, but can be delayed until 2 weeks before birth if a medical certificate is presented and if there has been no absence due to medical reasons within the period of pregnancy.
Paternity leave: employees are entitled to 13 working days of paternity leave. The first 3 days will be covered in full by the employer. From the 4th day until the 13th day, it will be covered by the National Health Insurance BPS. The leave must be taken from the day the baby is born.
Additionally, there is a 'new-born' care leave that can be used by any of the parents, where employees work half time until the 6th month. Half of the salary is borne by the employer and the other half by BPS.
In case of sick leave, the employee will receive 70% of his salary from the 4th day and will be covered by the National Health Insurance BPS. The first 3 days the employee is not entitled to receive a salary unless the sick leave includes hospitalization. The sick leave is unlimited.
Employees are entitled to a 13th salary and will receive it as 2 additional payments made in June and December. Employees will also be entitled to a 14th salary of approximately paid out when the employee takes their yearly vacation.
