Employment Contract Details
Employment contracts must be in writing and in English.
Probation period in the USA usually is not necessary as most employers can use employment at will.
Minimum Wage Requirements
The federal minimum wage for covered nonexempt employees is $7.25 per hour. Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
Maximum working hours and overtime
Maximum working time is generally 40 hours per week and 8 hours a day.
The federal overtime provisions are contained in the Fair Labor Standards Act (FLSA). Unless exempt employees are covered by the Act they must receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay.
There is no limit in the Act on the number of hours employees aged 16 and older may work in any workweek.
Parental leave falls under the federal Family and Medical Leave Act (FMLA), which requires employers to provide a maximum of 12 weeks of unpaid leave.
