Employment Contract Details
There are specific rules governing the language used to write employment contracts in Romania.Bilingual wording is permitted.Contracts must always be in writing and specify the type of employment agreed, trial period, restrictive covenants and notice.
The maximum probation period is 3 months, though for managerial positions they can be set to a maximum of 6 months.
Minimum Wage Requirements
The Minimum Wage is RON 2,300 per month.
Maximum working hours and overtime
Normal working time is generally 40 hours per week and up to 48 hours per week when overtime is allowed. Overtime work is compensated with a supplement of up to 100% of the regular hourly rate.
Bonus and expense payments
Bonuses may be paid. Terms and conditions are determined by the parties and must be included in the employment agreement to be enforced.
Either parent can take child-raising leave until the child is 2 years old. During parental leave, the parent receives a capped allowance equal to 85% of their average salary for the past 12 months from the National Social security fund.
- Maternity leave: lasts 126 days starting anytime between the pre- and post-birth period considering a minimum of 42 days must be taken after the child is born. During maternity leave, employees receive an allowance equal to 80% of their monthly salary paid by the National Social security fund.
- Paternity leave: employees are entitled to 5 working days’ leave within the first 8 weeks following the birth.
