Employment Contract Details
Employment contracts must be in writing and in Spanish.
The probation cannot exceed 3 months for regular workers, and 6 months or 1 year for managerial positions or specific type of workers that deals with confidential information, during which the contract may be terminated by either party without the payment of severance for termination without cause.
Minimum Wage Requirements
The Minimum Wage is PEN 930 per month.
Maximum working hours and overtime
Normal working hours are 48 hours per week, 8 hours per day plus 45 minutes per day for lunch. Overtime does not apply to home office workers or managerial roles and it is only allowed if previously authorized by the employer, enforced through the employment agreement.
Bonus and expense payments
There are 2 bonuses that must be paid in Peru, 13th & 14th salary are subjected to income tax and social security withholdings.
- Maternity leave: is granted for 98 calendar days (49 days of prenatal leave and 49 days after childbirth). Additionally, postnatal leave can be extended to 30 additional calendar days, under certain conditions. During maternity leave, employees receive an allowance equal to 100% of the salary paid by the state.
- Paternity leave: employees are entitled to 4 business paid days funded by the employer.
