Employment Contract Details
Employment contracts must be written. It is possible for them to be in English, and it has to mention the Retirement Age, set at 60 years old, in the agreement.
Not mandatory. However, the common practice for multinationals is 3-6 months, depending on the seniority of the employee.
Minimum Wage Requirements
Minimum wage requirements in India differ according to the governing state and employees' skill set.
Maximum working hours and overtime
The India workweek is 40 hours, with a standard workday of 8 hours. Overtime is paid double the rate of the standard pay.
Bonus and expense payments
There is a statutory bonus for companies employing 20+ employees, as stated by the Payment of Bonus Act, 1965. It ranges from 8.33% to 20% of the eligible amount and payable within 8 months of the end of the year.
- Maternity leave: Employees are entitled to 12-26 weeks of maternity leave and can be taken as early as 8 weeks prior to childbirth. The remaining weeks can be availed post-childbirth. For expectant employees, after having two children, the duration of paid maternity leave shall be 12 weeks. Maternity leave is paid in full after completing a minimum of 80 days working for the same company in the 12 months prior to the expected date of birth.
- Paternity Leave: there are no mandatory law for paternity leave in the private sector.
In India, sick leave is paid from 0.5 to 7 days' paid.
