The maximum probation period is 3 months.

Minimum Wage Requirements

The minimum wage is BRL 1,039 per month.

Maximum working hours and overtime

Normal working hours are 40 hours per week (Monday-Friday), 8 hours per day plus 1 hour per day for lunch; or 44h hours per week (Monday-Saturday) 8 hours per day plus 1 hour per day for lunch (Monday-Friday) and 4h per day on Saturdays.

Bonus and Expense Payments

Most employees are entitled to receive a statutory Christmas bonus corresponding to one monthly salary per year. Typically, 50% of the Christmas bonus must be paid by the 30th of November, and the other 50% on or before the 20th of December.

Parental Leave

  • Maternity Leave: employees are entitled to 120 days' leave. This period may commence up to 28 days before the due birth date. The employer is required to borne this benefit, they can then deduct it from corporate social security contributions due to the Social Security Agency.
  • Paternity Leave: employees are entitled to 5 paid days covered by the employer.

Sick Leave

In the event of sickness leave, and with the presentation of an appropriate medical certificate, the employer is required to cover employee’s salary during the first 15 days. After the fifteenth day of absence, the Social Security Agency (INSS) will pay a sick leave benefit to the employee.

Termination requirements for employees in

Contracts ca be terminated by any party with cause or without cause. Severance payment depends on the employee’s length of employment and notice period given.

Employer must also pay out the accrued severance fund, 13th salary and vacations plus vacation bonus.

Notice Period

In Brazil, the notice period is based on the length of the labor relationship:

  • Up to 1 year of employment - 1 month’s notice
  • 1+ year of employment - the notice period is increased by 3 days per full year worked until the maximum notice period of 90 days is reached.
