Employment Contract Details

There are no specific rules governing the language for employment contracts as long as the employee understands the contract language. Bilingual wording is recommended for employees without the relevant language skills. Contracts must be in writing.

Usually allowed the first month of employment.

Minimum Wage Requirements

The minimum wage is set by collective bargains and not by law. The lowest wage set by collective agreement was EUR 1,500 per month.

Maximum working hours and overtime

Normal working time is generally 38.5 hours per week. However workers can work up to 40 effective hours per week without an increased rate of pay. Work exceeding 40 hours per week entitles the worker to overtime payment.The overtime supplement varies according to the applicable collective agreement.

Bonus and expense payments

There are 2 bonuses that must be paid in Austria. 13th & 14th salary are subjected to payroll taxes.

Parental Leave

Parents are entitled to take a minimum of 3 months of unpaid parental leave between childbirth and the child’s second birthday. They can also take up to 1 month at the same time and decide who will take the remaining month. Parents may receive a childcare allowance paid by the government provided they don't reach a certain yearly compensation.

  • Maternity Leave: starts 8 weeks before childbirth and extends up to 8 weeks after the child is born. During this period, employees receive an allowance equal to the average of the last 3 gross salaries during the entire statutory maternity leave. The allowance is paid by social insurance. Unpaid post-natal leave is possible up until the child is 2 years old with the possibility to return to work afterward.
  • Parental pay is capped and paid by the social insurance.

Sick Leave

The principle of continued remuneration ensures that in the event of sickness, industrial accident and occupational illness and during rest cure and convalescence leave, employees’ remuneration will continue to be paid. The Sick Pay Act (EFZG) entitles employees to the full wage for up to 6 weeks. Additional weeks can be granted depending on the length of the labor relationship.

Termination requirements for employees in

Austria

At-will termination of employment for employers are not allowed; contracts may be terminated by mutual agreement or unilaterally for due cause (serious cause, unfit for the role, extinction of the role). Payment in lieu of notice is not permitted.

Throughout employment, employers contribute 1.53% of the employee’s gross salary to a severance fund. On termination, the employee can choose to be paid out the accrued amount or simply transfer the fund to a new employer who will continue to contribute.

Notice Period

In Austria, the notice period is based on the length of the labor relationship:

  • Up to 2 years of employment - 6 weeks' notice
  • Can reach up to 3 months' notice for employment lasting 5 years or more.
