Employment Contract Details
Employment contracts must be in writing and in Portuguese. Bilingual contracts are allowed.
The maximum probation period is 3 months.
Minimum Wage Requirements
The minimum wage is BRL 1.101,95 per month.
Maximum working hours and overtime
- Standard is 40 hours per week from Monday to Friday, 8 hours per day (plus 1 hour per day for lunch).
- Extended is 44 hours per week from Monday to Friday, 8 hours per day (plus 1 hour per day for lunch), and 4 hours per day on Saturdays.
Bonus and Expense Payments
Statutory Christmas bonus: most employees are entitled to receive a bonus corresponding to one monthly salary per year. Typically, 50% of the Christmas bonus is paid at the end of November, and the other 50% on or before the 20th of December.
- Maternity leave: employees are entitled to 120 days leave. This period may commence up to 28 days before the due birth date. The employer is required to give this benefit. It can then deduct it from corporate social security contributions due to the Social Security Agency.
- Paternity leave: employees are entitled to 5 paid days covered by the employer.
In the event of sickness leave, and with the presentation of an appropriate medical certificate, the employer is required to cover employee’s salary during the first 15 days. After the fifteenth day of absence, the Social Security Agency (INSS) will pay a sick leave benefit to the employee.
