Minimum Wage Requirements

The minimum wage is UAH 6,500 per month from January 2022 onwards, and UAH 6,700 from October 2022 onwards.

Individual Income Tax

The individual income tax rate is 18% in Ukraine. Income tax is calculated using a flat tax rate.

Employer Cost

The employer cost is generally estimated at 22% of the employee salary.

Overtime Pay & Maximum Hours

Standard working hours are 8 hours per day, 40 hours per week. The standard workweek is from Monday to Friday.

Maternity Leave

Pregnant employees are entitled to 126 days of paid leave. 70 days must be taken before the child's birth. 56 days must be taken after the child's birth. The employee will receive 100% of their average salary during this period, and the Social Insurance Fund will be responsible for this pay. The employee cannot extend leave.

Paternity Leave

Employees are entitled to 14 days of paid paternity leave. This leave can be taken up to 3 months from the child’s birth. The employee will receive 100% of their average salary during this period, and the employer will be responsible for this pay. The employee cannot extend leave.

Parental Leave

In Ukraine, no law covers parental leave. However, employees may be entitled to maternity leave and paternity leave.

Sick Leave

Employees are entitled to 4 months of sick leave. The first 5 days of paid leave are covered by the employee. All the days following this are covered by the Social Insurance Fund. The salary paid during this leave is based on the length of the employment insurance record ranging from 50% to 100%.

Termination Requirements

Terminations in Ukraine can be complex. There is no at-will termination in Ukraine for employers outside the probation period and termination must be done for just cause. Compliant terminations include:

  • Voluntarily by the employee
  • By mutual agreement
  • Unilaterally by the employer based on:
    • Probation period
    • Changes in the organization of production and labor
    • Appearance at work in a state of intoxication
    • Incompatibility of the employee to the position to which he was hired
    • Performance due to unsuitability for the job
    • Systematic non-fulfillment by the employee
    • Non-appearance for work for more than four months in a row due to temporary incapacity
  • By the expiration of the contract

Notice Period

The notice period is based on the grounds of dismissal.

  • By mutual agreement - no notice period
  • During probation period - 3 days of notice
  • Voluntarily by the employee - 14 days of notice
  • Unilaterally by the employer in cases of redundancy - 2 months of notice

Severance for Employees

Severance pay is paid if an employee is dismissed from work, not on his own initiative. The amount of severance pay is based on the circumstances of contract termination.

Refusal of the employee to transfer to work in another organization as well as the refusal of the employee to continue working due to changes in significant working conditions. 2. Conscription of an employee or owner 2 months’ salary
Violation by the owner or authorized body 3 months’ salary

 

Paid Time Off

Both full-time and part-time employees are entitled to a minimum of 24 days of paid time off (PTO) a year. PTO varies by type of employee:

  • Employees in the first or second category of disabled persons - 30 days of PTO
  • Employees in the third category of disabled persons - 26 days of PTO
  • Employees under the age of 18 - 31 days of PTO
  • Seasonal workers - proportional to time worked

PTO accrues monthly at 2 days per month. Employees are eligible to take PTO after 6 months of work.

Ukraine celebrates 11 public holidays. National public holidays include:

  1. New Year
  2. Orthodox Christmas Day
  3. International Women's Day
  4. Labor Day
  5. Easter
  6. Victory Day over Nazism in World War II
  7. Trinity
  8. Constitution Day
  9. Independence Day
  10. Defender’s Day
  11. Christmas

Employment Contract Details

Contracts must be in Ukrainian and can be bilingual. They must be in writing and signed by both parties.

A contract must include:

  • Place of work
  • Working hours
  • Break
  • Position
  • Rights and responsibilities
  • Amount of remuneration
  • Validity

Probation Period

Probation periods are not mandatory. There is no minimum probation period. The maximum probation period for non-blue collar employees is 90 days (3 months). For blue collar employees, the maximum probation period is 1 month.
