Minimum Wage Requirements

In Tunisia, the minimum wage is complex as it varies depending on the sector of the employee.

For Deel, most employees will have a minimum wage of TND 1,000 per month.

Employer Cost

The employer cost is generally estimated at 21% of the employee salary.

Overtime Pay & Maximum Hours

Standard working hours are 8 hours per day, 40 hours per week. The standard workweek is from Monday to Friday.

Overtime payment is not mandatory and may be included in the salary. Hours outside of standard work hours are considered overtime. Employees can work a maximum of 20 hours of overtime a week. For additional hours, employees are paid between 150%-200% of the hourly wage depending on the agreement between the employee and employer.

Maternity Leave

Pregnant employees are entitled to 2 months of paid leave. The employee will receive 40% of their average salary during this period, and Social Security will be responsible for this pay.

Paternity Leave

Employees are entitled to 2 days of paid paternity leave. The employee will receive 100% of the salary during this period, and the employer will be responsible for this pay.

Parental Leave

In Tunisia, no law covers parental leave. However, employees may be entitled to maternity leave and paternity leave.

Sick Leave

Employees are entitled to paid sick leave for up to 180 days depending on the particular case of sickness. The first 5 days are paid by the employer at 100% of salary. The remaining leave and percent pay is calculated on a case-by-case basis.

Termination Requirements

Terminations in Tunisia are complex. There is no at-will termination in Tunisia for employers outside the probation period and termination must be done for just cause. Employees have the right to appeal terminations prior to dismissal.

Compliant terminations include:

  • Voluntarily by the employee
  • By mutual agreement
  • Unilaterally by the employer based on:
    • Probation period
    • Objective grounds
    • Disciplinary dismissal
    • Performance due to unsuitability for the job
  • By the expiration of the contract

Notice Period

Notice period is mandatory, and the minimum notice is 1 month. It can be increased if stated in the employee agreement.

Severance for Employees

In Tunisia, all employees who are terminated are entitled to severance pay, unless terminated for disciplinary reasons. Severance pay is 1 month of salary per year of service.

Paid Time Off

Both full-time and part-time employees are entitled to 21 working days of paid time off (PTO) a year. PTO accrues monthly at 1.75 days per month. Employees are eligible for annual leave after 1 month of work.

Tunisia celebrates 12 national holidays over 15 days.

National public holidays include:

  3. Eid Al Fitr (3 days)
  4. Eid al-Adha (2 days)
  5. New Year's Day
  6. Revolution and Youth Day
  7. Independence Day
  8. Martyrs' Day

  12. Evacuation Day

Wet ink of the contract and a stamp from the municipality is required.

The documents must be completed 1 day before the start date.

Employment Contract Details

Contracts must be in Arabic or French and can be bilingual. They must be in writing and signed by both parties. A contract must include:

  • Name
  • Start date
  • Length of the employment
  • Job description
  • Termination conditions

Probation Period

Probation periods are not mandatory. The minimum probation period is 30 days and the maximum probation period is 180 days.
