Minimum Wage Requirements

The Minimum Wage is TWD 160 per hour, TWD 24,000 per month.

Individual Income Tax

The individual income tax depends on many variables, such as marital status, level of income, etc. The average ranges from 5% to 40%

16.57% - 19.48% of employee salary

Overtime Pay & Maximum Hours

An employee can work no more than 8 hours a day (not including overtime) and no more than 40 hours per week. They must have at least 2 rest days every 7 days, with 1 mandatory day off and 1 flexible rest day. An employee cannot agree to work on the mandatory rest day. The employee may agree to work on the flexible rest day, but higher overtime rates will apply.

Maternity Leave

Employees are entitled to 8 weeks' leave, which can be taken before or after childbirth.

Paternity Leave

Employees are entitled to 5 days' paid paternity leave.

Parental Leave

Employees with children under 3 years old are eligible for up to 2 years of unpaid leave for childcare. Leave must be for a minimum of six months. Employees covered by labor insurance with more than 1 year of coverage are eligible for a parental allowance.

Sick Leave

Employees receive a maximum of 30 days of non-hospitalized sick leave per year and up to 1 year of hospitalized sick leave. After 3 days of sick leave, employees receive 50% of their normal salary from their employer, and 50% from Labor Insurance, up to a maximum of 6 months. Employees can take additional unpaid leave with employer's approval if their paid sick leave and annual leave allowances have been used. The employer can grant the employee an absence of leave without pay for a maximum of 1 year.

Termination Requirements

Employee dismissal must be according to the Labor and Standards Act (LSA). Both employer and employee are required to provide notice or payment in lieu. Any non taken holidays, payments, or benefits must be paid upon termination.

Notice Period

In Taiwan, the notice period is based on the length of the labor relationship:

  • 3 months -1 year of employment - 10 days' notice
  • 1 - 3 years of employment - 20 days' notice
  • 3+ years of employment - 30 days' notice

Paid Time Off

In Taiwan, employees are entitled to paid holidays based on the length of their labor relationship:

  • 6 months of employment - 3 days' paid leave
  • 1 year of employment - 7 days' paid leave
  • 2 years of employment - 10 days' paid leave
  • 3 years of employment - 14 days' paid leave
  • 5 years of employment - 15 days' paid leave
  • 10+ years of employment - 1 additional day is given every year, the maximum annual leave is 30 days.

Non taken holidays can be carried over to the following year. If those holidays aren’t used within 2 years or if the employee’s contract is terminated they will have to be compensated.

Employment Contract Details

Written contracts are not mandatory, but most businesses use them as they are highly recommended. They need to follow the LSA requirements. Upon mutual agreement, an employment contract can be conveyed in Chinese, English or any other language. In case of any future dispute, Chinese translation will be required.

Probation Period

The maximum probation period is 3 months.
