Minimum Wage Requirements

The minimum wage is MAD 2,828 per month.

Individual Income Tax

The individual income tax ranges from 10% to 38%. Income tax is calculated according to progressive rates. Multiple additional factors may impact overall rates such as the household status and the number of children.

Employer Cost

The employer cost is generally estimated at 17.50% of the employee salary.

Overtime Pay & Maximum Hours

Standard working hours are 8.8 hours per day, and 44 hours per week. The standard work week is from Monday to Friday.

Overtime payment is mandatory and is not included in the salary. Hours outside of standard work hours are considered overtime. Employees can work a maximum of 138 hours over four months and 250 hours a year. For additional hours, employees are paid:

  • 125% of the hourly rate for overtime undertaken between 6:00-21:00
  • 150% of the hourly rate for overtime undertaken between 21:00-6:00
  • 200% of the hourly rate for overtime undertaken on weekends and public holidays.

Maternity Leave

Employees are entitled to 14 weeks of paid leave. 7 days must be taken before the child's birth. The employee will receive 100% of the salary during this period, and National Social Security Fund (CNSS) will be responsible for this pay.

Paternity Leave

Employees are entitled to 3 days of paid paternity leave. The employee will receive 100% of the salary during this period, and National Social Security Fund (CNSS) will be responsible for this pay.

Sick Leave

Employees are entitled to paid sick leave for up to 180 days. This leave is paid at different rates and by different payers depending upon length:

  • Up to the fourth day, the employee will receive 100% of the salary paid by the employer. 
  • From the fifth day up to 6 months, the employee will receive 66% of the salary paid by Social Security. 

Termination Requirements

Terminations in Morocco can be complex. There is at-will termination in Morocco for employers. Compliant terminations include:

  • Voluntarily by the employee
  • By mutual agreement
  • Unilaterally by the employer based on:
    • Probation period
    • Offense undermining honor, trust, or good morals
    • Disclosure of a professional secret that has caused damage to the company
  • By the expiration of the contract

Notice Period

The notice period will depend on the length of employment and seniority of an employee.

  • Manager
    • Less than 1 year of employment - 1 month notice period
    • Between 1 to 5 years of employment - 2 months notice period
    • Over 5 years of employment - 3 months notice period
  • Employee
    • Less than 1 year of employment - 8 days notice period
    • Between 1 to 5 years of employment - 1 month notice period
    • Over 5 years of employment - 2 months notice period

Severance for Employees

In Morocco, all employees who are terminated due to unfair dismissal are entitled to severance pay. 

Paid Time Off

Both full-time and part-time (pro-rata) employees are entitled to 18 working days of paid time off (PTO) a year. PTO accrues monthly at 1.5 days per month. Leave increase by 1.5 days for every 5 years an employee is employed, capped at 30 days.

Public Holidays

In Morocco, there are 15 public holidays per year. Additionally, there are religious holidays that mark the main festivals of the Muslim calendar. As the Muslim calendar follows the lunar calendar, the dates of the holidays change each year.

Public holidays (civil / non-religious holidays)

  • 1 January: New Year
  • 11 January: Independence Day
  • 1 May: Labor Day
  • 30 July: Throne Day
  • 14 August: Commemoration of the Allegiance of Wadi Eddahab
  • 20 August: Anniversary of the Revolution, the King and the People
  • 21 August: Birthday of King Mohammed VI
  • 6 November: Anniversary of the Green March
  • 18 November: Independence Day

Public religious holidays

  • Muslim New Year: the first day of the lunar year corresponds to the Hegira of Muhammad in 622.
  • Birthday of the Prophet (Al Mawlid): the 12th day of the 3rd month.
  • Eid al-Fitr: End of the month of Ramadan. 1st day of the 10th month. During 3 holidays, Moroccans celebrate with their families.
  • Eid-el-Kebir: Feast of the Sacrifice. 10th day of the 12th month. This festival is celebrated 70 days after the end of Ramadan and marks the beginning of the Hajj period (pilgrimage to Mecca). It is traditional to slaughter a sheep, in memory of the sacrifice of Abraham.

Employment Contract Details

Contracts must be in French and can be translated into English. They must be in writing and signed by both parties.

A contract must include:

  • Name
  • Remuneration
  • Position and job description
  • Location and working hours
  • Trial period
  • Paid time off
  • Professional obligations

Probation Period

The minimum probation will vary according to the category of the employee. The standard minimum probation period is 45 days, with a maximum of 90 days. However, for managerial positions, the minimum probation is 90 days and the maximum trial period is 180 days.
