Paid Time Off
In Kenya, employees are entitled to 21 working days off after 1 year of employment. If the employee worked less than a year, 1.75 days of paid time off will be granted per month worked.
There are 13 public holidays. If a holiday falls on a Sunday, then the proceeding Monday will be taken as a holiday.

Individual Income Tax
The Individual tax rate in Kenya is between 10% - 30% and will depend on the income of the employee.
The employer cost is 10% of the employee salary. If the National Housing Development Fund (NHDF) is approved, it will increase to 11.5%
The maximum probation period in Kenya is 6 months.
Minimum Wage Requirements
The Minimum Wage will depend on the industry that the employee works, it can range between KES 13,572.90 KES to KES 30,627.45.
Maximum working hours and overtime
The standard is 52 working hours per week over 6 days of work.
- Maternity Leave: employees are entitled to 91 days of maternity leave with full pay. To be eligible, they must give al least 7 days of notice and present a medical certificate. This leave is 100% financed by the employer.
- Paternity Leave: employees are entitled to 2 weeks of paternity leave with full pay. The payment is financed by the employer.
After 2 months of employment, an employee is entitled to sick leave of no less than 7 days with full pay. If the sick leave must continue, the employee will receive extra 7 days with half pay.
The 14 days of sick leave are annually renewed. To grant sick leave to an employee, a medical certificate must be presented.
Termination requirements for employees in
Termination can be initiated by the employer or the employee. Lawful termination of employment includes:
- Termination by agreement
- Termination by the employer: the employer shall give a cause, respect the notice period to terminate the contract and handle it in writing.
If the employee did not take paid time off, the employer must pay the corresponding amount.
In Nigeria, for full time employees, at least one month of notice period is required. The amount of notice period can increase, and must be in the employment agreement.
Severance pay is payable at the rate of 15 days for every year worked and is only payable in cases where termination is on account of redundancy.
