    In Hong Kong, employees are entitled to paid holidays based on the length of the labor relationship:

    The individual income tax depends on many variables, such as marital status, level of income, etc. The average ranges from 2% to 17%

    Employment Contract Details

    Employment contracts may be verbal or written in Hong Kong. Professional job contracts are usually in English.

    Probation Period

    The maximum probation period is 6 months. However, common practice is 3 months.

    Minimum Wage Requirements

    The minimum wage is HKD 37.50 per hour.

    Maximum working hours and overtime

    The common practice is to have 40-50 working hours per week and 5 workdays per week. There are no specific requirements regarding overtime work. However, if the employment contract provides payment for overtime work, the employer is legally obligated to provide these wages.

    Bonus and Expense Payments

    A 13th month, also called an 'End of Year Bonus', is often granted to employees before Chinese New Year, though this can commonly be replaced with a performance-related bonus.

    Parental Leave

    • Maternity Leave: employees are entitled to 14 weeks.
    • Paternity Leave: employees are entitled to 5 days.

    Sick Leave

    Employees are entitled to paid sick leave at the rate of 4/5ths of the employee’s average wage over the preceding 12-month period. Entitlement to sick leave may be accumulated at the rate of 2 paid days for each month of service during the first year of employment and at the rate of 4 paid sickness days for each month thereafter, up to a maximum of 120 paid sickness days. The entitlement to sickness pay only applies, however, to periods of absence due to sickness of no less than four consecutive days.

    Termination requirements for employees in

    The employment contract can be terminated by both parties if due notice or payment in lieu of notice is given. Severance must be paid in case the employee:

    • Has 2 years of seniority; and
    • Is dismissed due to redundancy or laid-off

    Any non taken holidays, outstanding wages and payments must be paid upon termination.

    Notice Period

    In Hong Kong, the minimum required notice period is 1 months' notice.
