Minimum Wage Requirements

The minimum monthly wage is GEL 20 per month and has not been updated in the past 30 years.

The average minimum wage is around GEL 1300.

Individual Income Tax

Personal income tax is applied at a single flat rate of 20%.

Payroll Cost

The employer cost is generally estimated at 2% of the employee salary.

Overtime Pay & Maximum Hours

Standard working hours are 8 hours per day, 40 hours per week. The standard work week is from Monday to Friday.

Overtime payment is mandatory. Hours outside of standard work hours agreed in the employment agreement are considered overtime. For additional hours, employees are paid 125% of the hourly rate.

Maternity Leave

Employees are entitled to 126 calendar days of paid leave. Social Security will pay 100% of the employee's average salary from the previous 3 months during this period capped at GEL 2,000 for the entire maternity leave period (this amount is subject to change). 

Paternity Leave

In Georgia, no law covers paternity leave, however, maternity leave may be shared with the father. Only the mother is eligible for the government payment and the father may not take the full 126 days. 

Parental Leave

Employees are entitled to no less than 12 weeks of unpaid childcare leave until the child turns 5 years old. This leave may be taken in whole or in part, but cannot be less than 2 weeks per year. 

Sick Leave

Both full-time and part-time employees in Georgia are entitled to 40 consecutive calendar days, or 60 calendar days within 6 months, of paid sick leave. Sick leave is paid at 100% of the employee’s regular salary by the employer. 

Termination Requirements

Terminations must respect complex rules and the rules of an employee’s employment country. The off-boarding is always handled by the Employer with the primary stakeholders. It may include ad-hoc fees as well as required or recommended steps on specific termination cases.

Terminations in Georgia can be complex. There is no at-will termination in Georgia for employers outside the probation period and termination must be done for just cause.

Compliant terminations include:

  • Voluntarily by the employee
  • Unilaterally by the employer based on:
    • Probation period
    • Objective grounds
    • Disciplinary dismissal
  • By expiration of the contract

Notice Period

Notice will depend on the type of termination.

  • Termination with a cause - 30 days
  • Resignation - 30 days
  • Probation period - no notice required

Severance for Employees

In Georgia, all employees who are terminated are entitled to severance pay. Severance pay is 1 month of the basic salary.

To protect you from unforeseen financial risks arising from terminations, Deel applies a Severance Accrual to all employment agreements in this country.  Deel has extensive expertise in managing litigation risk globally and our Severance Accrual calculation is based on the prevailing common-law or statutory entitlements and local best practices. In the event your employee resigns or is not entitled to severance, all unused amounts will be returned to you.

Paid Time Off

Both full-time and part-time employees are entitled to 24 working days of paid time off (PTO) a year. PTO accrues monthly at 2 days per month. 
Employees accrue vacation from their start date and may begin taking it immediately, however the employer has the right to reject vacation requests without reason if the employee applies before they have completed 11 months of service.

Onboarding

Onboarding takes 3 business days. The documents must be completed 1 day before the start date.

Employment Contract Details

Contracts must be in Georgian or English. They must be in writing and signed by both parties.

A contract must include:

  • Date of commencement of work and duration of employment
  • Working hours and rest time
  • Type of job: primarily or secondary employment
  • Position and type or description of work to be performed
  • The duration of paid time off, the duration of unpaid PTO and the procedure for granting these vacations
  • The procedure for termination of employment by the employer and the employee

Probation Period

Probation periods are not mandatory. The standard probation period is 90 days and the maximum probation period is 180 days.
