Minimum Wage Requirements

The minimum wage in China is based on the region or municipality. The minimum wage in Shanghai is RMB 2,590 and RMB 2,320 in Beijing.

Individual Income Tax

The individual income tax ranges from 3% to 45%. Income tax is calculated according to progressive rates. Multiple additional factors may impact overall rates such as the household status and the number of children.

Employer Cost

The employer cost is generally estimated at 41% of the employee salary.

Overtime Pay & Maximum Hours

Standard working hours are 8 hours per day, 40 hours per week. The standard work week is from Monday to Friday. However, this can vary based on the region. 

Overtime payment is mandatory. Hours outside of standard work hours are considered overtime. Employees can work a maximum of 3 hours of overtime per day and 36 hours per month. If agreed by the employer, employees are paid the following rates for additional hours:

  • 150% of average salary for extended working hours
  • 200% of average salary for work on a rest day (with no compensatory leave arrangement)
  • 300% of average salary for work on statutory holidays

Maternity Leave

Pregnant employees are entitled to 98 days of paid leave. The leave is generally granted 15 days before the day of delivery. The salary during this leave will be the average salary of all of the female employees in the company, or 3 times the minimum wage (whichever is greater). Social Security is responsible for the payment amounting to 3 times the minimum wage. All the amounts above are paid by the employer.

Paternity Leave

Employees are entitled to 15 days of paid paternity leave. If the employer has paid social insurance premiums for employees, the Social Security Center is responsible for the salary payment during leave (once the employer applies to the Social Security Center). The salary during paternity leave is the local social average wage standard. If the employee's salary is higher than the social average wage standard, the employer shall make up the difference. Thus, the employee will receive 100% of their base salary.

The employee can extend leave using childcare leave.

Parental Leave

Parental leave varies based on the region that the employee is based in. Employees in Beijing and Shanghai are entitled to 5 days of parental leave each year until their child turns 3 years old. Both parents can take this leave and decide how to distribute the time off. For specific salary settlements, most regions provide base salary during statutory parental leave.

Sick Leave

Sick leave in China is very complex. Employees are entitled to paid sick leave ranging from 3 to 24 months. The length of leave and compensation varies based on seniority and length of employment with the same employer.

Sick leave renumeration will be treated on a case by case situation, as it will depend on specific factors relating to the employee.

Termination Requirements

Terminations in China can be complex. There is no at-will termination in China for employers, outside the probation period, and termination must be done for just cause.

Compliant terminations include:

  • Voluntarily by the employee under the following circumstances:
    • Working conditions do not conform to the law
    • The employer does not pay the remuneration stated on the employment agreement
  • By mutual agreement
  • Unilaterally by the employer under the following circumstances if the employee:
    • During probation period
    • Withheld information (degree, qualifications, diseases) that can affect work
    • Caused damage to the company or neglects duties
    • Committed illegal activities
    • Disclosed business secrets
    • Does not meet acceptable standards of work before or after being trained
    • Absent from work for more than 5 working days without the prior consent of the General Manager
    • Employed or engaged in other trade or business organization without the written consent of the employer
    • Had a conflict of interest that can cause harm to the interests of the company
  • By the expiration of the contract

Notice Period

The minimum notice period is 1 month and can be increased based on the employer’s discretion.

Severance for Employees

In China, severance pay is based on the length of employment with the same employer. It is paid at the rate of 1 month's wage for each year worked, rounded up to the nearest 0.5 or 1 year.

Paid Time Off

Full-time employees are entitled to 5 to 15 days of paid time off (PTO) a year, based on the length of employment. PTO accrues monthly, prorated based on their length of employment. Employees are eligible for annual leave after one year of employment.

  • Up to 1 year of employment - No PTO entitlement
  • Between 1-10 years of employment - 5 days of PTO
  • Between 10-20 years of employment - 10 days of PTO
  • 20+ years of employment - 15 days of PTO

PTO for part-time employees depends on negotiations between the employer and employee.

Public Holidays

Full-time employees are entitled to 5 to 15 days of paid time off (PTO) a year, based on the length of employment. PTO accrues monthly, prorated based on their length of employment. Employees are eligible for annual leave after one year of employment.

  • Up to 1 year of employment - No PTO entitlement
  • Between 1-10 years of employment - 5 days of PTO

Employment Contract Details

Contracts must be in English or a national language (Chinese, Japanese, Korean, etc.) and can be bilingual. They must be in writing and signed by both parties.

A contract must include:

  • Name
  • Start date
  • Length of the employment
  • Position and responsibilities
  • Working hours
  • Remuneration, labor protections, and labor insurance
  • Termination conditions

Probation Period

Probation periods are not mandatory. The minimum probation period is 1 month, and the maximum probation period is 6 months.
